JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but it would appear from perusal of the first information report that more than 150 persons assembled to make protest against the death of a person and when the police party reached there, allegedly, petitioner and others started pelting stones causing injuries to the police officials. Petitioner does not have any criminal antecedent and having similar allegation, one co-accused Prashottan Kumar @ Purushottam Kumar has already been granted privilege of bail by this Court, whereas petitioner is in jail custody since 30.04.2016.

Accordingly, let the petitioner, above named, be

Patna High Court Cr.Misc. No.34327 of 2016 (2) dt.22-08-2016 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Sherghati at Gaya in connection with Gurua P.S.Case No. 48 of 2016.
