The petitioner has prayed for bail in a case registered for the offence punishable under sections 420, 363, 506/34 of the Indian Penal Code.

As per allegation in the FIR, daughter of the informant has transferred huge amount from the joint account of the informant and his wife to the account of FIR named accused persons including the petitioner and his daughter fled away with co-accused Gangadhar Singh.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Victim girl was recorded u/s 164 Cr.P.C. wherein she has not made any

She also stated that she herself transferred money to the account of petitioner and other accused persons. There is no direct or indirect material has come against he petitioner to show his complicity in the present case. Petitioner has no criminal antecedent and languishing in judicial custody since 9.1.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Khagaria P.S. Case No. 857 of 2022.
