1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 127(1), 115(2), 118(2), 109, 117(2), 303(2), 352, 351(2), 3(5) of the BNS.
3. Learned counsel for the petitioners after arguing vehemently for some time, realizing his difficulty, seeks permission to withdraw the anticipatory bail application with
Patna High Court CR. MISC. No.23087 of 2025(2) dt.01-05-2025 2/3 respect to petitioner no.5, namely, Sribhagwan Rawat @ Bhagwan Rawat.
4. Permission is accorded.
5. It is next submitted that rest of the petitioners are persons with clean antecedent and the informant alleges that on account of dispute amongst children relating to toilet, the accused persons came and Sunil assaulted Balmukund by farsha, causing injury on head, while Pintu assaulted Dharmendra by an iron rod causing injury on head, thereafter Sribhagwan assaulted Jawahar by rod fracturing his leg and accused also snatched chain, money etc. of the informant.
6. The learned counsel submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that Janta Bazar P.S. Case No.19/2025 from the side of the petitioners was instituted against the side of the informant and others. It is also submitted that petitioner no.2 herein also sustained grievous injury and he was treated at PMCH. It is next submitted that though Sunil and Pintu are alleged to have assaulted Balmukund and Dharmendra but then the injury suffered by them have been opined to be simple in nature, which amply demonstrates that they never had any intention of committing a serious occurrence and the blow was
Patna High Court CR. MISC. No.23087 of 2025(2) dt.01-05-2025 3/3 not repeated. It is next submitted that though it is alleged that Sunil assaulted by farsha but then the injury suffered by Balmukund is caused by hard and blunt substance.
7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Janta Bazar P.S. Case No.20/2025, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
