05.08.2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in a case registered for the offences under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

According to the prosecution itself, it appears that co-accused Pawan Kamat and Bhagwan Jha opened fire upon the deceased and so far as the petitioner is concerned, the allegation of conspiracy has been leveled against him. Moreover, several co-accused have been granted bail either anticipatory bail or regular bail whereas the petitioner is in custody since 20.05.2016 without having any criminal antecedents.

Considering the aforesaid facts and circumstances, let the Petitioner, above named be released

No.30592 of 2016 (2) dt.05-08-2016 on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Bihra P.S.
