JUSTICE SANJAY PRIYA ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner and State. The petitioner apprehends his arrest in Mahua P.S. Case No. 71 of 2008 instituted for the offence under sections 304 (B), 201, 364/34 of the Indian Penal Code.
The petitioner is the husband of the deceased. From the written report, it appears that petitioner used to make demand of motorcycle and for non-fulfillment of the aforesaid demand, she was done to death in her Sasural. The informant went to Sasural of his sister and did not find any family member and also learnt that dead body of his sister has been disposed off. C.D. has been received.
The learned A.P.P. has submitted that the witnesses in paras 5,6,7, 8, 9 and 14 have all supported the case and there was
Patna High Court Cr.Misc. No.4451 of 2017 (3) dt.28-02-2017 specific allegation against this petitioner. They have stated that dead body has been disposed off.
Therefore, after looking into the nature of allegation and the statements of witnesses as stated above, this court does not find it a fit case for grant of anticipatory bail. Accordingly, the prayer of anticipatory bail is rejected.
