The petitioner seeks bail in a case instituted under Section 395 of the Indian Penal Code.

The prosecution story, in brief, is that while the informant was travelling from Rosera to Dalsinghsarai along with his friend a pillion rider for business work and as soon as he reached five meters south of Dahu chowk, six miscreants with two motorcycles waylaid him and made him to fall down by pushing him and started fleeing away taking his bag, containing Rs. 2,25,000/- and some clothes and thereafter the petitioner taking the lift with another traveler, the informant chased the miscreants raising an alarm and police was also informed and in

Patna High Court Cr.Misc. No.37268 of 2016 (3) dt.27-10-2016 2/2 that course, the local people also chased the miscreants and in that course three miscreants riding on a motorcycle fell down and they were caught hold, out of whom one disclosed his name as the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.06.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. There is no recovery of any looted article from the possession of the petitioner. The other co-accused has been granted bail by the learned court below vide B.P. No.555 of 2016.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri M. M. Alam, A.C.J.M.-III, Rosera, Samastipur in connection with Bibhutipur P.S. Case No. 146 of 2016.
