JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 302 of the Indian Penal Code.
Allegation against petitioner is that he had killed husband of the informant.
It has been submitted on behalf of petitioner that he is in custody since 19.5.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Informant is not eye witness to the occurrence. Petitioner has been named in F.I.R. merely on the basis of suspicion. Post mortem examination report does not indicate any external or internal injury.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
