JUSTICE RAKESH KUMAR ORAL ORDER 20-08-2016 Heard Sri Ajay Kumar Singh no.1, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 25.03.2016 in connection with Gandhi Maidan P.S. Case No.50/2016 registered for the offence under Section 379 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that save and except confessional statement of one of the accused, there is nothing against the petitioner. He submits that no material has been recovered from the possession of the petitioner and only on suspicion, the petitioner has been arrested. Learned Addl. Public Prosecutor has opposed the prayer for bail of the petitioner.

No.32238 of 2016 (2) dt.20-08-2016 2/2 However, keeping in view the nature of accusation and period of custody, let the petitioner, namely, Raushan Kumar be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand ) with two sureties of the like amount each to the satisfaction of Smt. Supriya Goshwami, learned Judicial Magistrate, 1st Class, Patna in connection with Gandhi Maidan P.S. Case No.50/ 2016.
