Petitioner seeks bail in Sessions Trial No.301 of 2018 arising out of Warisnagar P.S. Case No.27 of 2018 instituted for the offence under Section(s) 302/34 Indian Penal Code.
It is alleged in the written report that brother of the informant sustained fire arm injuries. The informant was taking his brother to hospital in injured condition then he told that Ajit Kumar Rai @ Butlal Rai and Nandan Kumar with two unknown persons has caused fire arm injury to him near Petrol Pump. The Additional Sessions Judge has mentioned in the impugned order that name of this petitioner has come in the confessional statement of co-accused, Nandan Kumar and Ajit
Patna High Court Cr.Misc. No.59616 of 2018 (2) dt.06-10-2018 2/2 Kumar. They have disclosed before the police that this petitioner had made available pistol to Ajit Kumar, who fired at the deceased.
Petitioner is in custody since 01.05.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the 3rd Additional Sessions Judge, Samastipur, in connection with Sessions Trial No.301 of 2018 arising out of Warisnagar P.S. Case No.27 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
