JUSTICE SUDHIR SINGH ORAL ORDER 08-09-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 302, 201 and 34 of the Indian Penal Code. Allegation is that due to previous enmity petitioners along with other accused persons killed son of the informant and subsequently, his dead body was recovered.
It has been submitted on behalf of the petitioners that they are in custody since 11.4.2016. Chargesheet has been submitted against the petitioners. Petitioners have got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioners. They have been named in the F.I.R. merely on the basis of suspicion. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest their implication in the present case. On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail
Patna High Court Cr.Misc. No.30886 of 2016 (3) dt.08-09-2016 2/2 bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Madhubani, in connection with Jai Nagar P.S. Case no. 289 of 2015.
