The petitioners seek bail in a case registered for offences punishable under Sections 30, 30 (b) and 38 (i) (ii) of the Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, about 87 litres 840 Ml. of foreign liquor was recovered from a Maruti Suzuki Car which was being boarded by three persons including the petitioners. It is contended that nothing has been recovered from the conscious possession of the petitioners and he has been falsely implicated in the present case. Petitioners claim that they are having clean antecedents and are in custody since 04.08.2018.

No.59922 of 2018(3) dt.08-10-2018 2/2 Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Sitamarhi, in connection with Runni Saidpur P.S. Case No. 450 of 2018. If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
