The petitioners are seeking anticipatory bail in connection with Goh P.S. Case No. 13 of 2019 registered under Sections 341, 323, 354B, 379, 447, 506, 509/34 of the Indian Penal Code. Learned counsel for the petitioners submits that as per prosecution version that when daughter of the informant was sweeping her door, petitioners came on motorcycle and began to make her sit on the said bike, when she raised alarm informant came out of his house then the petitioners fled away leaving their motorcycle on the spot. It is submitted that husband of the informant is paddy dealer which fact is admitted in the first information report. It is also stated that petitioners have no criminal antecedent.

Patna High Court CR. MISC. No.18272 of 2019(2) dt.04-04-2019 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioners.

Considering the facts and circumstances of the case where it is the submission of the petitioner that the husband of the informant is paddy dealer which fact is admitted in the F.I.R. also by the informant and that because these petitioners were pursuing with her husband to pay the amount of the paddy crop which the husband of the informant had purchased the present case came to be lodged against the petitioners and further that these petitioners have no criminal antecedent, in the event of their arrest/surrender before the court below within a period of four weeks, let the above-named petitioners be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad (Bihar), in connection with Goh P.S. Case No. 13/2019, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
