The statement of victim has been recorded under section 164 of the Cr.P.C. which prima facie goes to show that she was consenting party. The age of the victim was found by the medical board as 17 years.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Jhanjharpur, in connection with Laukahi P.S.Case No. 97 of 2016.
