2. The petitioner is apprehending arrest in connection with Mahila P.S. Case No. 43 of 2023 lodged on 24.05.2023, for the offence punishable under Sections 376, 354(c), 506, 323 & 34 of the Indian Penal Code.

3. As per the prosecution, FIR has been lodged against three named accused persons including the present petitioner. It has been alleged in the FIR that the petitioner has raped the informant many times and when the informant left the house of her nanad, then all accused persons have assaulted the informant with fists and slaps.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the petitioner and informant are nephew and aunt (bhagna and mami). Counsel submits that the informant has filed a petition before the SDJM, Darbhanga that on wrong pretext, the present case has been lodged. Counsel further submits that the petitioner has no criminal antecedent. Counsel submits that the consensual relation has been developed between petitioner and the informant for which case has been filed subsequently at the instance of the villagers.

5. Learned Counsel for the informant supports the contention of the petitioner. Counsel submits that the present FIR has been lodged on 24.05.2023, whereas, the alleged offence took place on 05.04.2022 and further on 20.04.2023. Counsel submits that a petition has been filed by the informant indicating the circumstances under which the case has been filed.

6. Learned APP for the State opposes the prayer for bail of the petitioner but submits that there is a petition filed by the informant denying the FIR itself.

7. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on

Patna High Court CR. MISC. No.19317 of 2025(2) dt.16-04-2025 3/3 bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Darbhanga, in connection with Mahila P.S. Case No. 43 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
