JUSTICE SUDHIR SINGH ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code.

Allegation is that informant after collecting money was returning and on the way the miscreants looted Rs.1,25,000/-, a cheque of Rs.10,000/- and a mobile phone from the informant on the point of pistol.

It has been submitted on behalf of the petitioner that he is in custody since 7.4.2016. Petitioner is not named in the F.I.R. He has not been put on T.I.P. Name of the petitioner has come on the confessional statement of the co-accused. It is further submitted that petitioner may be released after completion of nine months in custody, i.e., from 7.4.2016.

On behalf of the State, it is submitted that petitioner's name has come in course of investigation.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of nine months in custody, i.e., from 7.4.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the

Patna High Court Cr.Misc. No.28904 of 2016 (3) dt.31-08-2016 2/2 like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Balthar P.S. Case no. 4 of 2016.
