JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 363,366,366A, 34 of the Indian Penal Code. The allegation against the petitioner and other coaccused is of kidnapping the daughter of the informant, while she was returning from school, for the purpose of performing marriage.

It is submitted on behalf of the petitioner that the petitioner is in custody since 06.01.2016.Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. No doubt, the victim has not been recovered as yet but in course of investigation it has come that the

Patna High Court Cr.Misc. No.32371 of 2016 (3) dt.16-09-2016 2/2 petitioner and other helped co-accused Deepak Kumar in taking away the victim. There is admitted love affairs of victim with coaccused Deepak Kumar. It is further submitted that co-accused Anand Mohan Kumar @ Anand Mohan has been granted bail vide Annexure 2 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Motihari in connection with Madhuban P.S.Case No. 5 of 2016.
