The petitioner is languishing in custody since 05.02.2015 in connection with Special Case No. 14 of 2015 arising out of Kadam Kuan P.S. Case No. 48 of 2015 pending in the Court of 1st Additional District and Sessions Judge, Patna registered for offences under Sections 376(D), 365, 506/34 of the Indian penal Code and Section 4 of the POSCO Act.
Earlier bail application of the petitioner was rejected vide Cr. Misc. No. 15649 of 2015 with observation to the trial Court to conclude the trial within a period of one year. In the light of the said observation, the petitioner has preferred the present application for bail. This is the second attempt on behalf of the
Patna High Court Cr.Misc. No.25922 of 2016 (3) dt.03-08-2016 petitioner.
A report was called for from the trial Court regarding the stage of the case which is kept at Flat 'A'. It has been reported that trial is likely to be concluded within a period of two months. Considering the aforesaid facts and circumstances I am not inclined to release the above named petitioner on bail, the same is rejected.
The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of two months from the date of receipt/production of a copy of this order. (Sudhir Singh, J) Prakash/- U T
