The petitioner is in custody since 09.06.2018 in connection with Dinara P.S. Case No. 183 of 2018 for the offence registered under Section 414 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner has been taken into custody in connection with theft of motorcycle only because he was speaking with two persons, who were engaged in getting the motorcycle repaired at a work shop. It is further submitted that when the police enquired from the petitioner as to who were the two persons, who having noticed the arrival of police, fled away, the petitioner named the two persons i.e. Hare
Patna High Court Cr.Misc. No.59478 of 2018 (2) dt.28-09-2018 Ram Kumar and Gallu Kumar, who were known to the present petitioner. It is further submitted that the alleged recovery of two live cartridges, mobile as well as cash were attributed to the petitioner but such mobile phone was his own phone. It is further submitted that the loaded country made pistol was also not recovered from his possession. It is further submitted that as and when required, he shall co-operate in the investigation and be present in Court on being so summoned.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Bikramganj, Rohtas in connection with Dinara P.S. Case No. 183 of 2018, subject to the condition that one of the bailors will be his own blood relative.
