JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner and the learned counsel representing the State.

The petitioner wants to renew his prayer of bail which was earlier rejected by order dated 21.12.2015 passed in Cri. Misc. No. 48353 of 2015, on the ground that the petitioner is in custody since 19.05.2015. No witness has been examined up till now though, charges have been framed on 19.02.2016 and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of bail by submitting that the petitioner and co-accused committed gang rape with the informant.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of bail, again the

Patna High Court Cr.Misc. No.33316 of 2016 (2) dt.07-09-2016 2/2 prayer for bail of the petitioner stands rejected. However, the learned trial court is directed to expedite the trial and conclude the same preferably within six months after receipt/production of a copy of this order, failing which if the petitioner at no fault, may be at liberty to renew his prayer for bail.
