JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 In this case earlier, the petitioner was enlarged on bail by a coordinate Bench of this Court vide order dated 06.10.2018 passed in Cr. Misc. No. 59256 of 2018 with condition that:- "Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bonds.

That apart, in view of the antecedents of the petitioner, he would be required to appear before the Superintendent of Police, Vaishali at Hajipur within fifteen days of his release with a copy of this order and every two weeks thereafter for the next six months. The conduct of the petitioner will be kept under watch in the aforesaid period by the Superintendent of Police concerned and if it is found wanting in any respect, a report shall be made to the court concerned by him to initiate a proceeding for cancellation of bail for

Patna High Court CR. MISC. No.59256 of 2018(8) dt.07-08-2019 2/2 reasons of misuse of bail. After reporting to the Superintendent of police, a certificate will be filed by the petitioner before the court concerned which should be granted by the Superintendent of Police upon his appearance.

In view of the above order, a report was submitted by the Superintendent of Police, stating therein that petitioner has violated the order of Hon'ble High Court and has again been found involved in similar offence. A report was also received from the court concerned that the bail bond of the petitioner was cancelled vide order dated 07.01.2019 for default in compliance of this Court's order.

Since, now the bail bond of the petitioner has already been cancelled, he has to surrender in the court of learned Special Judge, Excise, Vaishali, Hajipur, if not surrendered and thus the earlier order passed by this Court, does not require any interference.
