Petitioner, who is in custody, seeks bail in a case registered for the offence punishable under Section 409 of the I.P.C.

Allegation as per FIR is that the petitioner collected money from the Rama Bandh Bus Stand and not deposited to the Zila Parishad, as such, there is allegation of misappropriation of Rs.15-20 lacs against the petitioner and he is named in the FIR and the case is of the year 2006. It has been submitted on behalf of petitioner that he is innocent and has been falsely implicated in this case. Petitioner is only a Peon and it looks improbable that he collected

Patna High Court CR. MISC. No.32998 of 2021(2) dt.28-09-2021 2/2 such a huge amount and the allegation against him is false and concocted. Petitioner has no criminal antecedent and is in custody since 01.01.2021.

Considering the fact that the petitioner was absconding for over 12 years, I am not inclined to grant bail to the petitioner at this stage. Accordingly the prayer for bail is rejected.

However, petitioner may renew his prayer for bail after framing of charge.
