Apprehending arrest, the petitioner filed A.B.P. No.4618 of 2012 in the court of the Sessions Judge, Patna. The same was dismissed on 11.2.2013. Hence, this application for grant of anticipatory bail under Section 438 of Cr.P.C. Heard learned counsel for the petitioner and learned A.P.P. for the State.
In this case several adjournments had been granted and the Court issued several directions. However, the fact remains that the principal allegation against the petitioner is referable to under
Patna High Court Cr.Misc. No.8360 of 2013 (8) dt.01-04-2015 2/2 Section 498A of the I.P.C. This Court is of the view that arrest of the petitioner is not warranted in such case. Hence, the application is allowed.
In the event of arrest, the petitioner is directed to be released on bail on furnishing bail-bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar-II, learned Judicial Magistrate, Patna, in connection with Complaint Case No.1127(C) of 2010, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
