Petitioner seeks bail in a case registered under sections 341, 323,504, 506 of the Indian Penal Code and section 53(B) of the Bihar Excise (Amendment) Act.
The accusation against the petitioner is that he created nuisance in public place in intoxicated condition. Petitioner was medically examined and his blood was found alcoholic. Petitioner is in jail custody since 31.5.2016 and does not have any criminal antecedent.
Submission on behalf of the petitioner is that the petitioner has been implicated in this case due to political rivalry and, as a matter of fact, neither petitioner had consumed liquor nor created nuisance. Considering the aforesaid facts and circumstances as well as

No.28784 of 2016 (2) dt.26-07-2016 the period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Naugachia in Naugachia P.S. Case no. 87/2016.
