The petitioner is in custody in connection with Darauli P.S. Case No. 256 of 2018, registered for the offence punishable under Section 395 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner was not named in the FIR. He further submits that the name of the petitioner surfaced on the confessional statement of co-accused Dhiraj Kumar Sharma. Learned counsel for the petitioner submits that petitioner is student of JRS College, Siwan. He submits that petitioner is in custody since 07.01.2019.
Considering the aforesaid facts as discussed above, the Court is inclined to grant bail to the petitioner. Let, the
Patna High Court CR. MISC. No.19757 of 2019(2) dt.01-04-2019 2/2 petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Chief Judicial Magistrate-III, Siwan, in connection with Darauli P.S. Case No. 256 of 2018. Further, subject to verification that the petitioner is student of JRS College, Siwan and he used to attend the class in B.Sc. And if the Court below on verification finds that the petitioner is used to attend the class, petitioner be released on bail otherwise Court below shall refuse to release the petitioner on bail.
