This Court in Civil Rev. No. 746 of 2003 by order dated 18.07.2003 had directed that the Title Suit is of the year 1996, therefore, the same should be disposed of within a year. Call for a report from the Court of learned SubJudge, 1st, Patna City as to why the Title Suit No. 160 of 1996 is not disposed of. If the Sub-Judge finds that the plaintiff is cooperating in the matter and the defendants are not cooperating in the matter, then he will proceed in the suit against the noncooperating party. If the Sub-Judge finds that the plaintiff is not taking any interest in the suit, then the suit shall be dismissed for default on the very next date without granting unnecessary adjournment.

The suit must be disposed of within six months, after hearing the suit on day-to-day basis.

Accordingly, this application is disposed of with the aforesaid direction.
