The petitioner seeks bail in Andharamath P.S. case No. 89 of 2015 registered under Section 399, 400, 414 of the Indian Penal Code and under Section 25(1-b) A of Arms Act. The police after having got information about preparation of committing cognizable offence by some of the accused persons raided the spot but many persons managed to flee away. Five persons were apprehended. Mukesh Yadav, one of apprehended accused, disclosed the name of petitioner but no arms or ammunition was recovered from the possession of the petitioner.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner

Patna High Court Cr.Misc. No.61396 of 2018 (2) dt.06-10-2018 2/2 was not apprehended on the spot and name of petitioner figured in the case in the confessional statement of co-accused, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Madhubani in connection with S. Tr. No. 442 of 2016 arising out of Andharamath P.S. case No. 89 of 2015.
