The petitioner seeks bail in a case instituted for the offences under Sections 420, 468, 467 and 471 of the I.P.C. The allegation is that the accused persons including the petitioner have misappropriated huge amount of the government money.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.5.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. In course of investigation his name has come.
Patna High Court Cr.Misc. No.30529 of 2016 (4) dt.08-09-2016 2/2 The other co-accused has been granted bail vide Cr.Misc.No.13719 of 2016.
On behalf of the State and the learned counsel for the opposite party No.2, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chitragupta Nagar) P.S. case No.27 of 2016.
