The petitioner apprehends his arrest in Narpatganj P.S. Case No. 429/2017, instituted for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 427, 452, 504, 120(B), 333 and 506 of the Indian Penal Code read with Section 3 of Damage of Pubic Property Act and Section 51(A) of Disaster Management Act.

Earlier prayer for anticipatory bail of the petitioner was rejected vide order dated 08.03.2018 passed in Cr. Misc. No. 12708/2018.

The present petition has been filed on the ground that subsequent to passing of the order dated 08.03.2018 in Cr. Misc. No.

Patna High Court Cr.Misc. No.61627 of 2018 (2) dt.10-10-2018 2/2 12708/2018 by this Court, some of the accused persons have been granted anticipatory bail.

This Court is not persuaded to pass any fresh order on aforesaid ground because earlier order dated 08.03.2018 was passed by this Court in Cr. Misc. No. 12708/2018 on merit. This petition is accordingly disposed off with direction to petitioner to surrender before the Court below within four weeks from the date of receipt/production of copy of this order and pray for regular bail, which shall be disposed off by the court below in accordance with law without being prejudiced by this order.
