The petitioner apprehends arrest in a case registered for the offence punishable under section 307, 504, 34 of the Indian Penal Code and Section 27 of Arms Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Though there is allegation of making celebratory firing by the petitioner and other accused persons but nobody sustained fire arms injury. It is further submitted that there is delay of four days in lodging of the FIR and there is no plausible explanation of delay. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.22821 of 2022(2) dt.08-09-2022 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI Bhojpur at Ara in Chauri Police Station Case No. 112/2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
