The petitioner seeks bail in Ander P.S. case No.133 of 2018 registered under Section 272, 273, 308 of the Indian Penal Code and under Section 30, 30 (a) of the Bihar Prohibition & Excise Act, 2016.

The informant, a police officer, got information that some persons including the petitioner were bringing illegal liquor on a truck. On such a truck bearing registration No. UP14DT-0248 was intercepted from which 3456 liters of Indian made foreign liquor was recovered.

The learned counsel for the petitioner submits that petitioner was not arrested on the spot. Nothing has been recovered from the possession of the petitioner. The police officer,

Patna High Court Cr.Misc. No.59955 of 2018 (2) dt.28-09-2018 2/2 of course, disclosed that he got information about the fact that petitioner and others were bringing the truck but petitioner was not apprehended with the truck. The petitioner has got no criminal antecedent.

Taking into consideration the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan in connection with Ander P.S. case No.133 of 2018.
