The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 354, 354B, 504, 379/34 of the Indian Penal Code and Section 8 of the POCSO Act.

Petitioners are said to have caught hold the hand of the informant and started to abuse her mother. On objection, petitioner no. 1 assaulted them and torn her cloth and snatched gold jewelry.

It is submitted by learned counsel for the petitioners that petitioners are innocent and have been falsely implicated in this case. He submits that the present case is

Patna High Court CR. MISC. No.30287 of 2021(4) dt.28-02-2022 2/2 counter blast of the case lodged by the mother of the petitioners against the informant. He further submits that petitioners have no criminal antecedent as stated in para-3 of this application. Learned APP for the State opposes the prayer for bail.

Considering the seriousness and gravity of the offence of making physical and sexual assault and harassment of a minor victim by the petitioners, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, their prayer for anticipatory bail is rejected in connection with Ara Nagar P.S. Case No. 579 of 2020.
