ANJANA MISHRA ORAL ORDER 16-12-2015 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Halsi P.S. Case No.26 of 2015 for allegedly having committed the offences under Sections 302, 201 and 120B of the Indian Penal Code.

Case diary in the present case was called for, which has since been received.

Learned counsel for the petitioners submits that save and except the suspicion, there is no material so as to implicate the petitioners. Petitioner no.1 is the wife, petitioner No.2 is the mother-in-law and petitioner nos.3 and 4 are brothers-in-law of the deceased. It is submitted on behalf of the petitioners that only

No.36880 of 2015 (3) dt.16-12-2015 2/2 a wild allegation has been levelled against petitioner no.1 that she was involved with some other person and save and except the said allegation, there is no material in the case diary so as to implicate her in connection with the present case. Learned counsel appearing on behalf of the State submits that the case diary, too, does not give any further material so as to implicate these petitioners. Considering the aforementioned facts and circumstances and that the petitioners have no criminal history, let all the four petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.

10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai, in connection with Halsi P.S. Case No.26 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
