Heard learned Counsel for the petitioners and learned Counsel appearing on behalf of the State.
Petitioners are apprehending their arrest in connection with Daud Nagar P.S. Case No. 148 of 2015 registered for offences punishable under Sections 341, 323, 325, 307, 379, 504 and 506 of the Indian Penal Code.
Learned Counsel for the petitioners submits that though there is an allegation of Maarpit between the informant and petitioner side, the injuries which have been sustained are not such
Patna High Court Cr.Misc. No.37478 of 2015 (3) dt.22-12-2015 2/2 which could cause threat to life. It is further submitted that the injuries though found initially simple but later they are found to be on the vital parts of the body.
Considering the fact that there is a history of litigation between the parties and that there is a land dispute and both parties at logger heads and further that the petitioners have no criminal antecedents, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate Daud Nagar, Aurangabad in connection with Daud Nagar P.S. Case No. 148 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
