Petitioner prays for bail in connection with Forbesganj (Simraha) P.S.Case No. 138 of 2018 registered for the offence punishable under Section 395 of the Indian Penal Code. Allegation against the petitioner is of committing road robbery and petitioner is not named in the FIR. Submission of learned counsel for the petitioner is that except confessional statement there is nothing against the petitioner and the basis of said confession he has been made accused in one more case and petitioner is in custody since 25.6.2018.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.60448 of 2018 (2) dt.06-10-2018 2/2 circumstances, this application is disposed of with a direction to learned court below that once petitioner completes four months period in custody, he shall be released on bail to its own satisfaction.
