JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-06-2020 Heard Mr. Ajay Kumar Thakur, learned counsel for the petitioner and Mr. Rajendra Nath Jha, learned counsel appearing for the State through video conferencing. The petitioner seeks regular bail in connection with Sadar (Mabbi O.P.) P.S. Case No. 52 of 2020 registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code, 1860 and Section 25 (1-B)a/26/35 of the Arms Act. The allegation against the petitioner as per the First Information Report is that Police on the basis of secret information proceeded towards the place of occurrence and upon seeing the Police party miscreants assembled there tried to flee away and on chase five persons, including the petitioner, were apprehended and from the possession of the petitioner one mobile phone and one knife were recovered.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case and no offence

Patna High Court CR. MISC. No.18601 of 2020(2) dt.04-06-2020 2/2 under Section 399 and 402 of the I.P.C. is made out against the petitioner. Learned counsel further submits that no fire arms have been recovered from the possession of the petitioner and the petitioner has got no criminal antecedent. Learned counsel further submits that petitioner is in custody since 06.02.2020. Having regard to the submissions made by the parties and taking into consideration the fact that petitioner has got no criminal antecedent and he is in custody since 06.02.2020 , I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Sadar (Mabbi O.P.) P.S. Case No. 52 of 2020.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding lockdown and social distancing.
