2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 115(2), 121(1), 132, 262 and 3(5) of the B.N.S..

3. As per prosecution case, it is alleged that this petitioner, along with other co-accused persons, forcibly got released one co-accused persons from custody of police and while doing so, they assaulted the police party as a result of which some of the police personnel sustained injuries.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Allegation of assault is general and omnibus and no specific

Patna High Court CR. MISC. No.20982 of 2026(2) dt.01-05-2026 2/2 accusation of overt act has been alleged against this petitioner. Moreover, charge-sheet has already been submitted and petitioner is in custody since 30.10.2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Sheikhpura in connection with Chewara P.S. Case No. 65 of 2025.
