The petitioner seeks anticipatory bail in connection with Sangrampur P. S. Case No. 217 of 2018, corresponding to G.R. Case No. 8873 of 2018, registered for offences punishable under Sections 341, 323, 324, 379 and 307/34 of the Indian Penal Code.
Allegation as per F.I.R. against the petitioner is of assault to the informant with farsa blow on his head, causing injury. Submission of the learned counsel for the petitioner is that there is a case and counter case between both the parties and he has falsely been implicated in this case and the petitioner has no criminal antecedent.
Learned A.P.P. and learned counsel for the informant opposes the prayer for bail stating that injuries is grievous in
Patna High Court CR. MISC. No.18188 of 2019(2) dt.04-04-2019 2/2 nature.
Having heard both sides and in view of the facts and circumstances as discussed above, the case of the petitioner is concerned, I am not inclined to grant bail to the petitioner, Accordingly, prayer of anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrender before the court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court.
This application is accordingly dismissed.
