JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-09-2015 Heard learned counsels for the petitioner and the State.

The petitioner renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code and section 7 of the Essential Commodities Act.

The prosecution case is that 55 bags having emblem of FCI, 30 plastic bags along with jute bag containing 50 kg rice and 81 bags containing 40 kgs rice in each bag, were recovered. It is submitted by learned counsel for the petitioner that the recovery does not constitute any offence under the purview of sections 406 and 420 of the Indian Penal Code and 7 of the Essential Commodities Act.

Since, the prayer for anticipatory bail of the petitioner

Patna High Court Cr.Misc. No.37356 of 2015 (2) dt.15-09-2015 2/2 has been refused by a co-ordinate bench of this court, this court is not inclined to grant anticipatory bail to the petitioner. But on merits, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Wazirganj P.S. Case No.574 of 2013, pending before the learned CJM, Gaya.

With the above observation, this application is, accordingly, disposed off.
