This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Murliganj PS Case No. 08 of 2019 for the alleged offence punishable under Section 379 of the Indian Penal Code. It is alleged in the instant case that petitioner was caught hold by the police near a stolen motorcycle. Learned counsel representing the petitioner submits that the case was registered against unknown. The petitioner has no criminal antecedent and he had no knowledge that the motorcycle was stolen one. He further submits that petitioner has remained in custody since 09.01.2019.

Considering the fact that petitioner has no criminal

Patna High Court CR. MISC. No.18951 of 2019(2) dt.28-03-2019 2/2 antecedent and he has remained in custody since 09.01.2019, this application is allowed.

Accordingly, let the petitioner above-named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Madhepura in connection with Murliganj PS Case No. 08 of 2019.
