JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 341, 342, 364, 365, 379/34 of the Indian Penal Code. Petitioner and one co-accused made attempt to kidnap the informant and also assaulted him but due to timely arrival of the villagers, the informant could be saved.

Submission on behalf of the petitioner is that due to political rivalry, the present case has been lodged by the informant. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 26.5.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named

Patna High Court Cr.Misc. No.28707 of 2016 (2) dt.19-07-2016 2/2 be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-IV, Bhagalpur in connection with Lodipur P.S. Case No.60 of 2016.
