JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 323, 325, 342, 307 and 447 of the Indian Penal Code.
It is alleged that the petitioner assaulted the informant with 'farsa' on his head and other accused persons assaulted with iron pipe and iron rod.
It is submitted by learned counsel for the petitioner that injury of the informant has been found to be simple in nature and petitioner being the agnate of the informant has been made accused for a petty dispute. Moreover, the informant has retracted from initial version and has filed a petition to that effect before the learned court below, the same has been brought on record as
Patna High Court Cr.Misc. No.37662 of 2015 (2) dt.17-09-2015 2/2 annexure-4 to the petition. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sadar, Motihari, East Champaran in connection with Motihari Muffasil P.S. Case No.369 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
