The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 303, 324, 325, 307 and 504 of the Indian Penal Code. The prosecution case is that the petitioner along with other accused persons came variously armed and started assaulting the informant when sisters-in-law of the informant namely Manorama Devi, Rina Devi and son Sani Kumar came to rescue they were also assaulted. It is specifically alleged against this petitioner that he assaulted with 'farsa' on the head of Manorama Devi.

It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled and at

Patna High Court Cr.Misc. No.38182 of 2015 (2) dt.22-09-2015 2/2 earlier point of time the petitioner's side lodged a case against the informant's side.

Considering the fact that the accusation of assault is specific against the petitioner and corresponding incise injury has been found on the parietal and frontal region of injured Manorama Devi, let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bidupur P.S. Case No.176 of 2015, pending before the learned CJM, Vaishali at Hajipur.

With the above observation, this application is, accordingly, disposed off.
