The stolen motorcycle is said to have been recovered from the house of the petitioner on the basis of confessional statement made by co-accused but the impugned order goes to show that the alleged recovery was made in absence of the petitioner from a joint house. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 13.06.2016.
