JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-02-2017 Heard the learned counsel for the petitioners. The petitioners are apprehending their arrest in connection with Basopatti P.S. Case No. 62 of 2015, corresponding to G.R. No. 1361 of 2015 registered for the offences under Sections 364, 364A and 380 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that the allegation against the petitioners is that they kidnapped the son of the complainant/ informant and it is also alleged that the son of the informant had kidnapped the daughter of the petitioner no.1 and till date she is traceless. However, earlier to filing of this case, the petitioners have filed a police case against the informant and others stating that they have kidnapped the daughter of the petitioner no.1 and further the present case has been filed on 20.2.2015 after two months of the filing of the case of the

Patna High Court Cr.Misc. No.4243 of 2017 (2) dt.09-02-2017 2/2 petitioners and as such there is delay of two months in lodging the case.

Heard the learned the learned APP also.

Having heard both sides and considering the submission of the learned counsel for the petitioners that prior to that they had already lodged a case for kidnapping the daughter of petitioner no.1 and the present case has been lodged after a delay of two months and as such, let the petitioners, named above, in the event of their arrest or surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 25,000/- each with two sureties of the like amount each to the satisfaction of Munsif-I cum J.M. I, Madhubani in connection with Basopatti P.S. Case No. 1361 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
