ANJANA MISHRA ORAL ORDER 20-03-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Neemchak Bathani P.S. Case No.21 of 2013 for allegedly having committed the offences under Sections 302, 307/34 and other sections of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report and on account of political rivalry, the name of the petitioner has been brought into the present case. Learned counsel for the petitioner further submits that such allegation has been brought in at a later stage mainly for tarnishing his image.

Considering the aforementioned submissions and also

Patna High Court Cr.Misc. No.43420 of 2014 (2) dt.20-03-2015 2/2 the fact that the petitioner has no role to play and that his name has surfaced as an afterthought, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Neemchak Bathani P.S. Case No.21 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
