JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-01-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Narhat P.S. Case No. 92 of 2017 for the offence under Sections 304(B)/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedent. The petitioner has been made accused only because he happens to be the husband of the deceased and he is in custody since 15.10.2019. Learned counsel submits that initially the case was registered as U.D case and two days thereafter, the first information report was lodged in the present case. Considering the materials available on record, the

Patna High Court CR. MISC. No.17501 of 2020(5) dt.11-01-2021 2/2 Court is not inclined to grant bail to the petitioner. However, the court below is directed to expedite and conclude the trial on day-to-day basis within a period of six months from the date of receipt/production of a copy of this order.

The Superintendent of Police, Nawada is directed to ensure examination of all the prosecution witnesses so that the trial is concluded as indicated hereinabove.

In case the trial is not concluded despite full cooperation of the petitioner, the court below shall release the petitioner on bail on appropriate terms and conditions. The court below is under obligation to submit failure report for not following the observations made hereinabove before Registrar (Vigilance) of this Court for appropriate action. The application stands disposed of.

Let a copy of this order be communicated to the Registrar (Vigilance) of this Court.
