Petitioner is accused in connection with Parbatta (Maraiya) P.S. Case No. 84 of 2016 registered under Sections 302/34 of the I.P.C.

The prosecution case is that on 19.04.2016 at 6:00 am. Md. Amir, son of the informant moved from the house on bike to village Kolwara. The informant at 10:00 am., received information to the effect that his son is under treatment at P.H.C., Parbatta. Thereafter, he went there and came to know that six persons, including the petitioner caused assault to his son by fists and slaps. While the son of the informant sent to Khagaria for better treatment, but he died on the way.

Patna High Court Cr.Misc. No.34110 of 2016 (2) dt.17-08-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that there is general and omnibus allegation against the petitioner to cause injury at the deceased. It is also submitted that similarly situated co-accused Sudarshan Mandal has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 29264 of 2016 on 25.07.2016. It is further submitted that petitioner has no criminal antecedent and is in custody since 20.04.2016. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Khagaria in connection with Parbatta (Maraiya) P.S. Case No. 84 of 2016. Out of two sureties, one surety must be parents or close relatives of the petitioner.
