JUSTICE RAVI RANJAN ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences under Sections 457/380 of the Indian Penal Code. It is contended that, as per allegation, on 15.11.2017 at about 4.00 A.M. one Shiv Kumar informed the informant about the theft in Uttar Bihar Gramin Bank Branch Tappu by some unknown persons. When the informant arrived at the bank's branch he saw the grill was cut down by the miscreants and some articles such as DVR box, CBS etc. have been theft and the miscreants tried to break the locker but failed to do so

It is contended on behalf of the petitioner that neither he been has named in the First Information Report nor has any incriminating article been recovered from his possession. The petitioner has been apprehended on the basis of suspicion and only in view of the fact that he is having criminal antecedent. It is urged that the petitioner is in custody since 12.12.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Magistrate, Kishanganj in connection with Dighalbank P.S. Case No. 115 of 2017.
