The petitioner was allowed provisional bail by order dated 16.01.2019 passed in Cr.Misc.No.73592 of 2018 for three months from the date of release for getting treatment at the desired place. Thereafter, the petitioner got diagnosed at AIIMS, New Delhi and Medanta, Gurgaon. The pathological report and prescriptions of the Doctors of Medanta as well as AIIMS, New Delhi reveal that the petitioner is suffering from multiple disease including the uncontrolled diabetes, hyper tension, kidney disease and fatty lever. The Doctors have advised for

Patna High Court CR. MISC. No.22195 of 2019(2) dt.17-04-2019 2/2 surgery after sugar control in one or two months, vide advice dated 11.02.2019. The sugar level on fasting on 30.03.2019 was 513.97.

Considering the continued illness of the petitioner, the provisional bail is extended for further four months. Thereafter, the petitioner shall surrender before the learned court below. It is made clear that the trial must not hamper due to non-cooperation of the petitioner.

With the aforesaid modification, this application stands allowed.
