JUSTICE RAVI RANJAN ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Section 47 (A) of the Excise Act. There is recovery of 250 Kg. of Jawa Mahua and 10 liters of illicit country liquor.

It is contended that there is no recovery from the house of the petitioner rather the alleged recovery is from the field besides the house of the petitioner. It is urged that the petitioner is in custody since 12.04.2016 having clean antecedent. Considering the facts and circumstances of the case, the petitioner, namely, Chhathu Mahto is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.26544 of 2016 (2) dt.12-07-2016 2/2 satisfaction of the Judicial Magistrate-1st Class, Siwan in connection with C-III Case No.22 of 2014, Trial No.702/2016. However, it is made clear that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
